Before the contract is concluded, the Customer is provided with clear and comprehensible information regarding the essential characteristics of the products, their price, any delivery charges, the delivery date or timeframe, as well as any other information required by the applicable regulations.

LINGERIE LE CHAT takes the utmost care in the presentation and description of its products. Photographs and illustrations are for illustrative purposes only. Product offers are valid whilst stocks last. In the event of a product becoming unavailable after an order has been placed, the Customer will be notified as soon as possible by email. Where unavailability makes it impossible to fulfil all or part of the order, the corresponding amounts will be refunded without undue delay and no later than fourteen days following the relevant cancellation, via the original method of payment unless the Customer expressly agrees otherwise.

Prices are quoted in euros, inclusive of all taxes (TTC), excluding delivery charges or any other additional costs expressly indicated to the Customer before the order is confirmed.

LINGERIE LE CHAT reserves the right to amend prices at any time. The applicable price is that displayed at the time the order is confirmed, subject to any obvious pricing error.

Promotions and discounts apply in accordance with the terms and for the duration stated on the Website. Where a price reduction is advertised, the reference price is determined in accordance with the applicable regulations.

For any delivery to a country outside the European Union, the price invoiced by LINGERIE LE CHAT does not include any customs duties, import taxes, charges, levies or other local fees that may be required by the authorities of the destination country.

Where applicable, these sums are the sole responsibility of the Customer and must be paid directly by the Customer to the relevant authorities, the carrier or any other body concerned.

It is the Customer’s responsibility to enquire, prior to placing their order, about the rules, formalities and charges applicable in the country of delivery. LINGERIE LE CHAT shall not be held liable for the amount of such duties, taxes or charges, nor for any consequences arising from their non-payment by the Customer.

The Customer selects the products they wish to order and adds them to their basket. Before finally confirming their order, they may check the order details and the total price, correct any errors and read these Terms and Conditions.

The order is definitively confirmed by means of a function bearing the words ‘order with obligation to pay’ or any similar unambiguous wording. The order constitutes an obligation to pay.

Following confirmation, LINGERIE LE CHAT shall, without undue delay, send the Customer, by electronic means, an acknowledgement of receipt of the order on a durable medium, setting out the essential details of the contract.

LINGERIE LE CHAT may refuse or cancel an order for a legitimate reason, in particular in the event of fraud or attempted fraud, a payment issue, manifestly incorrect information, or an order of an abnormal or abusive nature, subject to the consumer’s rights.

For contracts concluded electronically involving a sum of 120 euros or more, LINGERIE LE CHAT shall retain the contract for the statutory period of ten years and shall ensure the Customer has access to it upon request.

The payment details entered by the Customer are transmitted securely to the relevant payment service provider in accordance with the applicable security protocols. LINGERIE LE CHAT does not have access to the Customer’s confidential banking details and does not retain them, except for any information that may be necessary for accounting purposes, fraud prevention or the management of payment disputes in accordance with the conditions set out in the applicable regulations.

In accordance with Article L. 132-2 of the Monetary and Financial Code, an instruction or undertaking to pay made by means of a payment card is, in principle, irrevocable, subject to the cases provided for by law.

In the case of payment via PayPal, Bancontact or Google Pay, the payment is processed using the PrestaShop Checkout solution, operated by PayPal. The Customer is redirected to the secure environment of the relevant service provider in order to complete payment for their order, in accordance with the terms of use of that service.

In the case of payment by bank transfer, the bank details required for payment are provided to the Customer during the ordering process. The order will only be prepared once the full amount due has been received in LINGERIE LE CHAT’s bank account. The products ordered may be reserved for a maximum of ten (10) days from the date the order is confirmed. If payment is not received within this period, LINGERIE LE CHAT may cancel the order.

LINGERIE LE CHAT delivers the products on the date or within the timeframe specified to the Customer at the time of ordering. In the absence of any specific indication or agreement, delivery shall take place without undue delay and no later than thirty days after the conclusion of the contract.

In the event of a breach of the obligation to deliver within the agreed timeframe, the Customer is entitled to the rights set out in Articles L. 216-1 et seq. of the Consumer Code, in particular the right, subject to the legal conditions, to require the seller to make delivery within a reasonable additional period and, failing that, to terminate the contract.

The risk of loss or damage to the products passes to the Customer at the moment when the Customer, or a third party designated by them other than the carrier provided by LINGERIE LE CHAT, takes physical possession of the products.

The Customer is advised to check the apparent condition of the parcel and the products upon delivery and to report any damage or irregularities to Customer Services without delay. This check does not limit the exercise of statutory guarantees

LINGERIE LE CHAT is bound by the statutory guarantees of conformity and against hidden defects in accordance with the conditions laid down by law. To invoke these guarantees, the Customer may contact Customer Services using the contact details set out in Article 6.

The consumer has a period of two years from the date of delivery of the goods to invoke the statutory guarantee of conformity should a lack of conformity arise. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it first appeared.

The statutory guarantee of conformity entails an obligation on the part of the trader, where applicable, to provide any updates necessary to maintain the conformity of the goods.

The statutory guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without significant inconvenience to them.

If the goods are repaired under the statutory guarantee of conformity, the consumer is entitled to a six-month extension of the original guarantee period.

If the consumer requests that the goods be repaired but the seller insists on replacement, the statutory guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price whilst retaining the goods, or terminate the contract and receive a full refund upon returning the goods, if the trader refuses to repair or replace the goods, if the repair or replacement takes place after a period of thirty days, if the repair or replacement causes significant inconvenience to the consumer, or if the lack of conformity persists despite an unsuccessful attempt to bring the goods into conformity.

The consumer is also entitled to a reduction in the price of the goods or to the termination of the contract where the lack of conformity is so serious as to justify this immediately. The consumer is not entitled to terminate the contract if the lack of conformity is minor.

Any period during which the goods are out of service for the purposes of repair or replacement shall suspend the remaining term of the guarantee until the goods have been returned in good working order.

These rights arise from the application of Articles L. 217-1 to L. 217-32 of the Consumer Code.

A seller who, in bad faith, obstructs the enforcement of the statutory guarantee of conformity is liable to the civil fine provided for in Article L. 241-5 of the Consumer Code.

The consumer is also entitled to the statutory guarantee against hidden defects pursuant to Articles 1641 to 1649 of the Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are retained, or to a full refund upon return of the goods.

Statutory guarantees apply independently of any commercial guarantee that may be granted.

In accordance with Articles L.221-18 et seq. of the Consumer Code, the Customer has a period of fourteen days to exercise their right of withdrawal without having to provide any reason or pay any penalties, except for the cost of returning the goods.

This period begins on the day on which the consumer, or a third party other than the carrier and designated by the consumer, takes physical possession of the order. In the case of an order comprising several products delivered separately, the period begins on receipt of the last product in the order.

The Customer may exercise this right using the standard form set out in the annex to these Terms and Conditions of Sale or by means of any unambiguous statement expressing their intention to withdraw.

The Website also provides, free of charge and throughout the withdrawal period, an online feature enabling the Customer to exercise this right, directly accessible via the"Withdraw from contract here" link located in the footer of every page of the Website. Once the online declaration has been submitted, an acknowledgement of receipt is sent to the Customer without delay on a durable medium (email).

The Customer must return the product, without undue delay and no later than fourteen days after communicating their decision to withdraw, to the following address: LINGERIE LE CHAT, 3 rue de la Caille, 71170 Chauffailles, France, unless otherwise specified to the Customer. The product must be returned in its original packaging, complete, labelled, new, unworn and unwashed.

The direct costs of returning the product are to be borne by the Customer.

The Customer is only liable for any depreciation of the product resulting from handling other than that necessary to establish the nature, characteristics and proper functioning of the product.

LINGERIE LE CHAT will refund all payments received in respect of the product subject to withdrawal, as well as, in the event of withdrawal relating to the entire order, the corresponding standard delivery charges. Any additional costs resulting from the choice of a delivery method more expensive than the standard method will not be refunded.

The refund will be made without undue delay and no later than fourteen days from the date on which LINGERIE LE CHAT is notified of the decision to withdraw. LINGERIE LE CHAT may defer the refund until the product has been received or until the Customer provides proof of dispatch (post office parcel drop-off receipt), whichever occurs first.

In the event of a partial return of an order that benefited from a discount, the refund will correspond to the price actually paid for the returned product(s) after deduction of the applicable discount.

The refund will be made via the same payment method used for the original transaction, unless the Customer expressly agrees to another method and provided that this refund does not incur any costs for them.

The right of withdrawal may not be exercised in the cases provided for in Article L. 221-28 of the Consumer Code. This applies in particular, where these conditions are met, to sealed goods which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the Customer after delivery.

In addition to the statutory right of withdrawal set out in Article 10 and the applicable statutory guarantees, LINGERIE LE CHAT offers its Customers a commercial returns policy subject to the conditions set out below.

1.     Returns from mainland France and Belgium

1.1.  For orders with an initial value of €120 or more (including VAT), the cost of returning items via Colissimo is covered by LINGERIE LE CHAT.

The Customer may request a prepaid return label by emailing [email protected], specifying the order reference and date. They will then receive, by email within 48 working hours, the prepaid Colissimo label to print, along with instructions for use (please remember to check your spam folder). Please pack your return parcel carefully and enclose the completed return slip or the one generated from your customer account.

If you do not request a prepaid label in advance, you will be responsible for the return postage costs. No refund will be given for postage costs.

1.2  For orders with an original value of less than €120 (including VAT), the return costs are borne by the Customer.

In this case, the Customer may:

-        Either ask LINGERIE LE CHAT to provide a prepaid label. The cost of this label, set at €7, will be borne by the Customer and will be deducted from the amount to be refunded.

-        Or arrange the return themselves, at their own expense, using the carrier of their choice.

2.     Returns from countries other than mainland France and Belgium

For orders delivered to a country other than France or Belgium, the cost of returns is borne entirely by the Customer.

The Customer is free to choose their preferred carrier, provided they use a delivery method that allows the parcel to be tracked.

3.     Conditions applicable to returned products

To benefit from this returns policy, products must be returned:

  • complete;
  • in their original packaging, where available;
  • with their labels and accessories attached;
  • unworn;
  • unwashed;
  • undamaged;
  • not soiled;
  • not altered.

Returned products are inspected upon receipt.

LINGERIE LE CHAT reserves the right to refuse any return made under this terms and conditions policy where the product shows signs of use, washing, alteration, damage or soiling.

This returns policy does not limit the exercise of the statutory right of withdrawal or the Customer’s rights under the statutory guarantees of conformity and hidden defects.

4.     Products not covered by the returns policy

For hygiene reasons, certain products may be excluded from this returns policy if they have been unsealed after delivery and can no longer be put back on sale under normal conditions of hygiene or health protection.

This exclusion applies only where it is justified by the nature of the product and the conditions under which it was unsealed. The Consumer Code also provides for an exception to the statutory right of withdrawal for goods unsealed after delivery which cannot be returned for reasons of hygiene or health protection.

5.     Gift wrapping

The cost of the gift wrapping option is not refunded under this returns policy.

This provision does not affect the consumer’s mandatory rights in the event of exercising the statutory right of withdrawal under the conditions laid down by law.

6.     Return address and procedures

Returns must be sent to:

LINGERIE LE CHAT

3 rue de la Caille

71170 CHAUFFAILLES

France

Customers are advised to keep the proof of posting and the parcel’s tracking number until their return has been fully processed.

Refunds for products returned under this terms and conditions policy will be issued once the products have been received and inspected, in accordance with the procedures set out on the Website. Any refund will be processed within two weeks of receipt of the returned parcel.
